1. Introduction

These Terms of Service (the "Terms") govern your access to and use of the XP One platform and all related services (the "Service") provided by LeadsMind AI LTD ("LeadsMind", "we", "us", or "our"), a Private Company Limited by Shares registered in England and Wales.

By creating an account, accessing, or using the Service in any way, you ("User", "you", or "your") agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Acceptable Use Policy, and any additional terms referenced herein. If you do not agree to these Terms, you must not access or use the Service.

The Service is designed exclusively for business-to-business (B2B) professional use. You represent and warrant that you are accessing the Service on behalf of a business entity, in your professional capacity, and that you are authorised to bind such entity to these Terms.

2. Eligibility

To use the Service, you must:

1. Be at least 18 years of age;
2. Have the legal authority to enter into a binding agreement on behalf of a business entity;
3. Not be located in a jurisdiction where use of the Service is prohibited by applicable law;
4. Provide accurate, current, and complete registration information.

3. Description of the Service

XP One is a Software-as-a-Service (SaaS) platform for B2B sales prospecting. The Service includes:

• LinkedIn data extraction (profiles, reactions, comments, events)
• Contact data enrichment (professional email addresses, phone numbers) via waterfall methodology
• Multichannel outreach sequences (email, LinkedIn, SMS, WhatsApp)
• Built-in CRM and pipeline management
• Data export capabilities (Excel, PDF)
• Chrome extension for browser-based data collection

4. Account Registration and Security

You must create an account to access the Service. You agree to provide truthful, accurate, and complete information during registration and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

5. Subscription and Payments

The Service is offered on a monthly subscription basis. Payments are processed monthly in advance via Stripe. The Service operates on a month-to-month basis with no long-term commitment. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

6. User Responsibilities

You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction, including data protection laws (UK GDPR, EU GDPR, CAN-SPAM Act, CCPA, PECR).

You acknowledge and agree that you are the data controller with respect to any personal data that you collect, process, or store through your use of the Service. LeadsMind acts as a data processor on your behalf.

7. Limitation of Liability

To the maximum extent permitted by applicable law, LeadsMind shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability shall not exceed the amounts paid by you in the twelve (12) months preceding the claim.

• Data misuse or selling enriched data
• Reverse engineering or competitive intelligence

Data Processing Agreement

Roles

You (Customer) are the data controller. LeadsMind is the data processor acting on your behalf under Article 28 of UK GDPR.

Security Measures

• Encryption in transit (TLS 1.3) and at rest (AES-256)
• Access controls and role-based permissions
• Regular security assessments
• Incident response procedures

Data Breach Notification

LeadsMind will notify you within 72 hours of becoming aware of any personal data breach.
